Abstract:  September 11, 2008 will mark the seventh anniversary of the war on terrorism.  It is gone on longer than the Civil War, World War I, or World War II.  It is an occasion for examining the balance struck between civil liberties and national security and what the presidential election is likely to mean for this.  Sadly, one of the worst aspects of American history has repeated itself:   there have been substantial losses of liberty, but not in a way that has made the country any safer.

Erwin Chemerinsky is the Dean and Distinguished Professor of Law at the University of California, Irvine School of Law.  He assumed this position on July 1, 2008 after four years as the Alston & Bird Professor of Law and Political Science at Duke University.  Prior to that he spent 21 years as a professor at the University of Southern California Law School, where he was the Sydney M. Irmas Professor of Public Interest Law, Legal Ethics, and Political Science.  He is the author of six books and over 100 law review articles.  He frequently argues appellate cases, including in the United States Supreme Court.
