An innocent Madison man who served more than six years in prison after being wrongly convicted of a sexual assault was released on November 13, 2009, through the efforts of the Wisconsin Innocence Project. Dane County Circuit Court Judge Patrick Fiedler overturned Shomberg’s conviction on the strength of new evidence.

Shomberg’s attorney is Clinical Assistant Professor Byron Lichstein, who worked on the case with his students from the Wisconsin Innocence Project at the University of Wisconsin Law School.

Update to this article: On November 20, 2009, Dane Country District Attorney Brian Blanchard announced that Shomberg will not be retried.

"The same factors that led Judge Fiedler to order a new trial would present major obstacles at a new trial, and we do not believe we could prove the case beyond a reasonable doubt based on all of the available evidence," Blanchard said.
