Course Description
The class will explore the Wisconsin Supreme Court's unique analysis of negligence cases, though every state has its view on preventing negligence from sliding into strict responsibility. We will revisit Palsgraf and examine other early cases which limited negligence recovery. We will discuss important early articles. We will concentrate on Wisconsin cases, and the path the Wisconsin Supreme Court and various justices have taken in negligence methodology. We will discuss an analysis acceptable to a majority of the present court.
